Terms and Conditions

Welcome to ZevioDC. By accessing our website, purchasing hardware, or renting server capacity, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully.
1. Definitions
- "Company," "We," "Us," or "ZevioDC" refers to the service provider and hardware seller.
- "Customer," "You," or "User" refers to the individual or entity purchasing services or goods.
- "Services" refers to server rentals, dedicated hosting, colocation, and cloud services.
- "Hardware" refers to physical servers, parts, and equipment sold by ZevioDC to the Customer.
2. Account Registration
To use our Services or purchase Hardware, you must create an account. You agree to:
- Provide accurate, current, and complete information.
- Maintain the security of your password and identification.
- Accept all responsibility for any and all activities that occur under your account.
ZevioDC reserves the right to refuse service or cancel orders at our sole discretion.
3. Server Rentals and Hosting Services
3.1. Subscription and Term
Server rentals are provided on a subscription basis (e.g., Monthly, Annually). The term begins on the date the server is provisioned and access details are sent to the Customer.
3.2. Ownership of Rented Equipment
For all rental/hosting services, the physical hardware remains the sole property of ZevioDC. The Customer is granted a license to access and use the hardware for the duration of the subscription.
3.3. Bandwidth and Usage
ZevioDC provides a specific bandwidth allocation as per your plan. Overage fees will apply if you exceed your allotted transfer limit. Unused bandwidth does not roll over to the next month.
3.4. Service Level Agreement (SLA)
We aim for a 99.9% Network Uptime.
- Maintenance: Scheduled maintenance is not considered downtime. We will attempt to provide 24-hour notice for scheduled maintenance.
- Credits: In the event of unscheduled downtime exceeding our SLA, you may be eligible for a service credit, capped at 50% of your monthly fee.
4. Sale of Server Hardware
4.1. Transfer of Title
For hardware purchases, title (ownership) passes to the Customer only upon full receipt of payment by ZevioDC.
4.2. Shipping and Risk of Loss
All Hardware sales are FOB Origin (Free On Board). The risk of loss or damage passes to the Customer once ZevioDC delivers the Hardware to the shipping carrier. Shipping dates are estimates and are not guaranteed.
4.3. Hardware Warranty
- New Hardware: Covered by the original manufacturer’s warranty. ZevioDC will assist in the RMA process but does not provide the warranty directly.
- Refurbished/Used Hardware: Sold "AS IS" or with a limited 30-day warranty from ZevioDC, as specified on the invoice.
4.4. Returns (Sales Only)
Hardware returns are subject to a 10% restocking fee. Returns must be requested within 30 days of receipt and must be in original, unopened packaging.
5. Payments and Billing
- Invoicing: Services are billed in advance.
- Late Payments: Invoices not paid by the due date may result in service suspension. A late fee of 5% may be applied.
- Taxes: Prices exclude taxes. You are responsible for all applicable sales, VAT, or use taxes.
- Chargebacks: Any chargeback dispute will result in immediate account suspension.
6. Acceptable Use Policy (AUP)
You may not use ZevioDC Services for:
- Illegal Activity: Hosting or distributing child sexual abuse material (CSAM), copyright infringement, or illicit drugs.
- Malicious Activity: Phishing, hacking, scanning, or distributing malware/viruses.
- Spam: Sending unsolicited bulk emails.
- Network Abuse: Launching DDoS attacks or causing degradation of the ZevioDC network.
Violation of the AUP will result in immediate termination without refund.
7. Data and Backups
ZevioDC is not responsible for your data. While we may utilize RAID arrays or other redundancy measures, these are not a substitute for backups. You are solely responsible for maintaining off-site backups of your data. ZevioDC accepts no liability for data loss caused by hardware failure, human error, or software corruption.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ZEVIODC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICES OR HARDWARE.
OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER TO ZEVIODC IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
9. Termination
- By Customer: You may cancel hosting services via your client portal. Cancellations must be made at least 7 days before the next billing cycle.
- By ZevioDC: We may terminate services immediately if you breach these Terms or fail to pay.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law principles.
